Just-is Denied

37years are good long days to live one life, but if this has to be spent in a place of no interest to you and without a company of friends and family may sound insane. Here is a case where a person called Jagjivan who hailed from the land of Lord Shri Rama, was kept behind the bars for 37 years without even being trialed.

People living larger than life either gets the privilege of paroles or to defend their cases with the aid of best lawyers in the business, even though having known to themselves and the world that they did the crime for which they are being trialed. But what a poor can do in such scenario, who normally survives battle everyday for the livelihood of self and his dependant family.

Whether the person in question was guilty or not is totally a different case altogether, but firstly he should be bestowed with the fundamental right of “Right to speech” to under go trial before being convicted. This might not be a one-off case, and with Digital media becoming very vigilant in bringing all truth in the public domain, many such heart touching stories may be revealed.

We blow our trumpets in the name of world’s largest democratic country, but do we really rejoice the fruits of democracy? Digital technology can play a major role to encounter injustice or denial of justice. If each case is trialed on merits…say in Points basis. The most heinous crime ranked (baseline points against each IPC section) above a crime committed which had less impact to society or an individual’s life. Similarly the weight age of a crime committed in the past should score more than the one’s committed in the recent time. The algorithm of many such parameters should gives us the merit list which law has to follow for fair and transparent trial.



Since law is just one example here with many such cases in it like 'Malegaon blast' case where trial is yet to commence for the accused even after 5years ; technology can improve the quality of every life by having it across various systems and hence giving a Fair, Transparent, and Swift solutions.
